1. Expression of Interest and Allotment

  • The Applicant(s) submits this Expression of Interest (“EOI”) to record their interest in the project “Vacation Village, Chikkamagaluru”. Submission of this EOI constitutes the Applicant’s request for consideration for allotment of a plot in the Project, subject to applicable laws and the terms and conditions hereof.
  • Submission of this EOI does not create any right, title, or claim in respect of any specific plot. Any confirmation of booking and/or allotment shall be strictly subject to realisation of the amount paid towards booking, availability of the plot, and issuance of a formal allotment letter by the Promoter, followed by execution and registration of the Agreement for Sale.
  • This EOI shall remain valid for a period of 180 (one hundred and eighty) days from the date of submission. The Promoter reserves the right, at its sole discretion, to accept, reject, or cancel this EOI and refund the amount paid towards booking, if any, without assigning any reason. No interest or compensation shall be payable on such refund.
  • In the event of rejection or cancellation of this EOI, the Promoter shall refund the amount paid towards booking, without interest, within thirty (30) days from the date of such rejection or cancellation. Upon such refund, neither party shall have any further claim against the other in relation to this EOI.
  • This EOI is personal to the Applicant(s) and shall not be transferable or assignable to any third party under any circumstances.

2. Project Planning and Development

  • The Project is a plotted development approved by the Assistant Director, Town and Country Planning Department, Chikkamagaluru vide sanction no. ADTCP-TP/6/2025.
  • The Promoter reserves the right to:
    • Revise, amend, or modify the project plans as required by technical, regulatory, architectural, or legal considerations.
    • Add, merge, reduce, or reconfigure land parcels and provide or take rights of way with neighbouring lands on a reciprocal basis.
    • Develop and launch the Project in one or more phases of varied sizes over time.
  • All brochures, images, and renders are purely indicative and shown for representational purposes only. The final development and amenities may differ from depictions in marketing materials, and only those specifications mentioned in the Agreement for Sale shall be binding.

3. Price, Taxes, and Payment Terms

  • The basic unit price of plots is indicative and subject to revision or withdrawal at the Company’s discretion.
  • The Applicant shall bear all applicable statutory and indirect taxes, including but not limited to GST, Stamp Duty, Registration Charges, Cess, Khata Transfer Charges, and any other government-imposed levies applicable on the date of issue or demand.
  • Any change or enhancement in taxation rates after the date of EOI or offer shall be borne in full by the Applicant.
  • Payments must be made only in favour of “ALPL 3 LLP – Collection A/c for Vacation Village” through Applicant/Co Applicant bank accounts. A penalty is applicable for cheque dishonour.
  • Payments will only be accepted from the Applicant’s or Co-Applicant’s account(s). The minimum advance amount for booking shall be 10% of the total sale consideration.
  • A penalty of ₹1,000 will be applicable for cheque dishonour. The Company generally does not accept cash payment; if required, such payment must be made only at the Company’s office with PAN verification and an official receipt.
  • The Company may adjust payments received towards any outstanding dues without prior notice.
  • The Applicant confirms that all payments shall comply with applicable laws, including FEMA, RBI, and PMLA regulations.

4. Payment Schedule and Default

  • The Applicant must adhere strictly to the payment timelines specified in the payment plan.
  • Delay in payments shall attract an interest penalty as prescribed under the Agreement for Sale.
  • The Company reserves the right to cancel the allotment for non-compliance or default and refund the amounts received after deductions as per the Agreement for Sale.

5. Plot Area and Possession

  • The plot area indicated in the brochure is approximate and subject to final measurement at the time of possession.
  • The final price will be calculated based on the actual area.
    • If the actual area increases, the Applicant shall pay the difference.
    • If the area is reduced, the Company shall refund the excess paid.
  • Plot boundaries will be marked by the Promoter, and boundary wall construction will be undertaken by the Promoter at the Applicant’s cost, as detailed in the Payment Plan.

6. Construction and Development Guidelines

  • To maintain architectural uniformity and overall project consistency, any future construction on the plot by the Applicant must comply with the Company’s approved designs, development guidelines, and applicable building norms.
  • The Applicant shall not object to or deviate from the prescribed guidelines relating to design, elevation, floor plans, or density parameters.

7. Maintenance Charges

  • The initial maintenance charge will be ₹5 per sq. ft. per month plus applicable GST.
  • The Applicant shall pay a 2-year advance towards maintenance and a one-year equivalent amount towards the Corpus Deposit, as specified in the payment plan.
  • These rates are subject to revision as per the Agreement for Sale, and the Applicant undertakes to make timely payments.

8. Registration and Legal Matters

  • The cost of travel and incidental expenses for registration shall be borne by the Applicant.
  • The Applicant confirms having reviewed and understood the Project’s legal documents, land titles, and associated approvals.
  • The Company shall not be liable for any changes in laws, rules, or government policies that may impact the Project.

9. General and Legal Provisions

  • This document records an Expression of Interest and does not constitute a binding contract for sale. No right, title, or interest in any plot arises until execution of the Booking Form and Agreement for Sale.
  • The detailed obligations, rights, and liabilities of both parties shall be governed strictly by the Agreement for Sale.
  • Terms of cancellation, refund, and possession are subject to the provisions in the Agreement for Sale.
  • The interpretation and enforcement of these terms shall be under the jurisdiction of Bengaluru, Karnataka.

Important Notes:

  1. Nature of EOI: This Expression of Interest (EOI) is a non-binding request for consideration and does not constitute a final allotment, offer of sale, or an agreement to sell any specific plot in the project “Vacation Village, Chikkamagaluru.”
  2. RERA Registration: The project is registered with the Real Estate Regulatory Authority, Karnataka, bearing RERA Registration No. PRM/KA/RERA/1255/477/PR/280126/008430. Final bookings will be processed only through a formal allotment letter and execution of an Agreement for Sale, as per RERA and applicable laws.
  3. Validity: The EOI is valid for 180 days from the date of submission, and the Promoter may accept, reject, or cancel the EOI at its sole discretion.
  4. Refund Policy: In case the EOI is rejected or cancelled, or if no allotment is made, the amount paid under the EOI will be refunded without interest within 30 days of such rejection or cancellation, in accordance with the terms of the EOI and applicable law.
  5. Payment Source: All payments must be made only from the bank accounts of the Applicant or Co-Applicant. Third party payments are not permitted.
  6. Regulatory and Legal Compliance: Selling price, plot areas, specifications, master plans, layouts, amenities, and other project details are subject to approvals, revisions, and statutory compliances as disclosed under RERA. Only the terms in the Allotment Letter and Agreement for Sale will be binding.
  7. Terms and Conditions: : All transactions are subject to the detailed Terms and Conditions set out in the Application form and the Agreement for Sale.
